    1. Introduction

    These terms and conditions shall govern the visitors/users of Innovative 3D Printing solution’s (i3D) website.

      1. By using i3D’s website, the visitor/user accepts these terms and conditions in full; accordingly, if the visitor/user disagrees with these terms and conditions or any part of these terms and conditions, the visitor/user must not use i3D website.
      2. If the visitor/user registers with i3D’s website, submits any material to i3D’s website or uses any of i3D’s website services, i3D’s website will ask the visitor/user to expressly agree to these terms and conditions.
      3. The visitor/user must be at least 18 years of age to use i3D’s website; by using i3D’s website or agreeing to these terms and conditions, visitor/user warrant and represent to i3D that the visitor/user is at least 18 years of age.
      4. i3D’s website uses cookies; by using i3D’s website or agreeing to these terms and conditions, visitors/users consent to i3D’s use of cookies in accordance with the terms of i3D’s privacy and cookies policy.

    2. Licence to use website

    1. Visitors/users may:
      1. view pages from i3D’s website in a web browser;
      2. download pages from i3D’s website for caching in a web browser;
      3. print pages from i3D’s website;
      4. stream audio and video files from i3D’s website; and
      5. use i3D’s website services by means of a web browser, subject to the other provisions of these terms and conditions.
    2. Except as expressly permitted BY THE provisions of these terms and conditions, visitors/users must not download any material from i3D’s website or save any such material to his/her/their computer.
    3. Visitors/users may only use i3D’s website for their own personal and business purposes, and must not use this website for any other purposes.

    6. I3D reserves the right to restrict access to areas of i3d’s website, or indeed i3D’s whole website, at i3D’s discretion; visitor/user must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on i3D’s website.

    3. Acceptable use

    1. User/visitor must not:
    • (a) use i3D’s website in any way or take any action that causes, or may cause, damage to the website or impairment of the performance, availability or accessibility of the website;
    • (b) use i3D’s website in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
    • (c) use i3D’s website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
    • (d) conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to i3D’s website without i3D’s express written consent;
    • (e) access or otherwise interact with i3D’s website using any robot, spider or other automated means, except for the purpose of search engine indexing;
    • (f) violate the directives set out in the robots.txt file for i3D’s website; or
    • (g) use data collected from i3D’s website for any direct marketing activity, including without limitation email marketing, SMS marketing, telemarketing and direct mailing.
    • (h) Visitors/users must not use data collected from i3D’s website to contact individuals, companies or other persons or entities.
    • (i) Visitors/users must ensure that all the information they supply to i3D through i3D’s website, or in relation to i3D’s website, is true, accurate, current, complete and non-misleading.

    4. Registration and accounts

    • Visitors/users may register for an account with i3D’s website by completing and submitting the account registration form on this website, and clicking on the verification link in the email that the website will send to the registered email address.
    • Visitors/users must not allow any other person to use their account to access the website.
    • Visitors/users must notify i3D in writing immediately if they become aware of any unauthorized use of their account
    • Visitors/users must not use any other person’s account to access the website, unless they have that person’s express permission to do so.

    5. User Login Details

    • If visitors/users register for an account with i3D website, i3D will provide visitor/user with OR visitor/user will be asked to choose a user ID and password.
    • Visitors/users user ID must not be liable to mislead; visitors/users must not use visitors/users account or user ID for or in connection with the impersonation of any person.
    • Visitors/users must keep their password confidential.
    • Visitors/users must notify i3D in writing immediately if they become aware of any disclosure of their password
    • Visitors/users are responsible for any activity on i3D’s website arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

    6. Cancellation & Suspension of Account

    1. i3D may:
      • suspend visitors/users account;
      • cancel visitors/users account; and/or
      • edit visitors/users account details, at any time in i3D’s sole discretion without notice or explanation.
    2. Visitors/users may cancel their account on i3D’s website using their account control panel on the website.

    7. Your content: license

    1. In these terms and conditions, “visitors/users content” means all works and materials including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files that visitors/users submit to i3D or i3D’s website for storage or publication on, processing by, or transmission via, i3D’s website.
    2. Visitors/users grant to i3D a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute their content in any existing or future media OR reproduce, store and publish their content on and in relation to this website and any successor website OR reproduce, store and, with their specific consent, publish visitors/users content on and in relation to this website.
    3. Visitors/users hereby waive all their moral rights in their content to the maximum extent permitted by applicable law; and visitors/users warrant and represent that all other moral rights in their content have been waived to the maximum extent permitted by applicable law.
    4. Visitors/users may edit their content to the extent permitted using the editing functionality made available on i3D’s website.
    5. Without prejudice to i3D’s other rights under these terms and conditions, if visitors/users breach any provision of these terms and conditions in any way, or if i3D reasonably suspect that they have breached these terms and conditions in any way, i3D may delete, unpublish or edit any or all of visitors/users content.

    8. Your content: rules

      1. Visitors/users warrant and represent that their content will comply with these terms and conditions.
      2. Visitors/users content must not be illegal or unlawful, must not infringe any person’s legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).
      3. Visitors/users content, and the use of visitors/users content by i3D in accordance with these terms and conditions, must not:
        • be libellous or maliciously false;
        • be obscene or indecent;
        • infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;
        • infringe any right of confidence, right of privacy or right under data protection legislation;
        • constitute negligent advice or contain any negligent statement;
        • constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity;
        • be in contempt of any court, or in breach of any court order;
        • be in breach of racial or religious hatred or discrimination legislation;
        • be blasphemous;
        • be in breach of official secrets legislation;
        • be in breach of any contractual obligation owed to any person;
        • depict violence in an explicit, graphic or gratuitous manner;
        • be pornographic, lewd, suggestive or sexually explicit;
        • be untrue, false, inaccurate or misleading;
        • consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;
        • constitute spam;
        • be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory; or
        • cause annoyance, inconvenience or needless anxiety to any person.

    9. Limited Warranties

      1. i3D does not warrant or represent:
        1. the completeness or accuracy of the information published on i3D’s website;
        2. that the material on the website is up to date; or
        3. that the website or any service on the website will always remain available.
      2. i3D reserve the right to discontinue or alter any or all of i3D’s website services, and to stop publishing i3D’s website, at any time in i3D’s sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, visitors/users will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if i3D stops publishing the website.
      3. To the maximum extent permitted by applicable law, i3D excludes all representations and warranties relating to the subject matter of these terms and conditions, i3D’s website and the use of i3D’s website.

    10. Breaches of these Terms and Conditions

      1. Without prejudice to i3D’s other rights under these terms and conditions, if visitors/users breach these terms and conditions in any way, or if i3D reasonably suspect that visitors/users have breached these terms and conditions in any way, i3D may:
        1. send visitors/users one or more formal warnings;
        2. temporarily suspend visitors/users access to i3D’s website;
        3. permanently prohibit visitors/users from accessing i3D’s website;
        4. block computers using visitors/users IP address from accessing i3D’s website;
        5. contact any or all of your internet service providers and request that they block visitors/users access to i3D’s website;
        6. commence legal action against visitor/user, whether for breach of contract or otherwise; and/or
        7. suspend or delete visitor/user accounts on i3D’s website.
      2. Where i3D suspends or prohibits or blocks visitors/users access to i3D’s website or a part of i3D’s website, visitors/users must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account).

    11. Variation

      1. i3D may revise these terms and conditions from time to time.
      2. The revised terms and conditions shall apply to the use of i3D’s website from the date of publication of the revised terms and conditions on the website, and visitors/users hereby waive any right they may otherwise have to be notified of, or to consent to, revisions of these terms and conditions. OR i3D will give visitors/users written notice of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of i3D’s website from the date that we give visitors/users such notice; if visitors/users do not agree to the revised terms and conditions, they must stop using i3D’s website.
      3. If visitors/users have given their express agreement to these terms and conditions, i3D will ask for visitors/users express agreement to any revision of these terms and conditions; and if they do not give their express agreement to the revised terms and conditions within such period as i3D may specify, i3D will disable or delete visitors/users account on the website, and visitors/users must stop using the website.

    12. Assignment

      1. Visitors/users hereby agree that i3D may assign, transfer, sub-contract or otherwise deal with visitors/users rights and/or obligations under these terms and conditions.
      2. Visitors/users may not without i3D’s prior written consent assign, transfer, sub-contract or otherwise deal with any of visitors/users rights and/or obligations under these terms and conditions.

    13. Severability

      1. If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
      2. If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

    14. Third party rights

      1. A contract under these terms and conditions is for i3D’s benefit and visitor/user benefit, and is not intended to benefit or be enforceable by any third party.
      2. The exercise of the parties’ rights under a contract under these terms and conditions is not subject to the consent of any third party.

    15. Entire agreement

      1. The terms and conditions, together with i3D’s privacy and cookies policy, shall constitute the entire agreement between visitor/user and i3D in relation to visitors/users use of i3D’s website and shall supersede all previous agreements between visitor/user and i3D in relation to visitors/users use of i3D’s website.

    16. Law and jurisdiction

      1. These terms and conditions shall be governed by and construed in accordance with Indian Law.
      2. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Delhi, India only.
